These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Clearwater, Florida.
REQUEST FOR RELEASE OF FUNDS
On or about September 17, 2010, the City of Clearwater, Florida will submit a request to the U. S. Department of Housing and Urban Development (HUD) under the Housing and Community Development Act of 1974, as amended, to undertake a housing development project known as Country Club Homes for the purpose of providing affordable housing, the estimated federal funding for this project is 2.2 million dollars. An additional 4.5 million dollars will be provided by non-federal sources for the project located at Betty Lane and Drew Street, Clearwater Florida.
FINDING OF NO SIGNIFICANT IMPACT
The City of Clearwater has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file At the City of Clearwater Economic Development and Housing Department located at 211 South Osceola Avenue, Clearwater, Florida where the ERR can be examined or copied weekdays 8:00 A.M to 5:00 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the U. S. Department of Housing and Urban Development Department, Office of Community Development and Planning, Charles E. Bennett Federal Building, 400 West Bay Street, Suite 1015, Jacksonville, Florida for receiving and responding to comments. All comments received by September 17, 2010 will be considered by the U.S. Department of Housing and Urban Development prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The City of Clearwater certifies to HUD that Mr. William B. Horne II, in his capacity as the City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s/State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Clearwater, Florida to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of fund and the City’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases:
(a) the certification was not executed by the Certifying Officer of the name of City; (b) the City has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58;
(c) the City has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or
(d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the U. S. Department of Housing and Urban Development – Miami Field Office, Brickell Plaza Federal Building, 909 Southeast First Avenue – Suite 500, Miami, Florida 33131-3028. Potential objectors should contact HUD to verify the actual last day of the objection period.

The City of Clearwater, 112 South Osceola Avenue, Clearwater, Florida 33756 gives notice that it will submit another request for release of grant funds and an environmental certification to the U. S. Department of Housing and Urban Development (HUD) fifteen (15) days following this publication. The request and certification related to the activities cleared in a prior environmental release.
On or about August 11, 2006, Pinellas County completed an environmental review for all areas of the county including Planning Sector 6, the Greater Clearwater Area. Pinellas County submitted and received a release of funds from the HUD for the Community Development Block Grant Program, Home Investment Partnership Program and Emergency Shelter Grant Program. The funds identified in this release covered activities related to housing services, housing rehabilitation and preservation, code enforcement, acquisition, clearance and demolition, direct homeownership assistance, commercial/industrial improvements, economic development, historic preservation, public services, public facilities and improvements, relocation, and administrative services.
The City is hereby certifying to HUD that this agency and Mr. William B. Horne II, in his official capacity as City Manager, consent to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making, and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon HUD’s approval, the City may use the funds, and HUD will have satisfied its responsibilities under the National Environmental Policy Act of 1969 and the related laws and authorities. HUD will accept an objection to its approval of the release of funds and acceptance of the certification only if it is on one of the following bases:
a) that the certification was not in fact executed by the chief executive officer or other officer of applicant approved by HUD; or
b) that the applicant’s environmental review for the project omitted a required decision, finding, or step applicable to the project in the Environmental Review Process.
c) other specific grounds in HUD regulations at 24 CFR Part 58.75.
Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58), and may be addressed to the U. S. Department of Housing and Urban Development, Community Planning Division, 400 W. Bay Street, Jacksonville, FL 33202. Any objections received after September 10, 2010 will not be considered by HUD.
NOTICE OF FINDING OF NO SIGNIFICANT IMPACT
The City of Clearwater also gives notice that it has been determined that the activities listed in the Notice of Request for Release of Funds will not constitute an action significantly affecting the quality of the environment and accordingly, the City of Clearwater has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA, 42 USC 4321).
The City will comply with the approved Pinellas County Environmental Monitoring Strategy for each activity or project subject to the National Environmental Policy Act (NEPA) of 1969 and other provisions of law that further the purpose of NEPA.
An Environmental Review Record for the activities have been made by the City of Clearwater which documents the environmental review for the activities and more fully sets forth the reasons why such Statement is not required. This City adopted Pinellas Environmental Review and Review for Planning Sector 6, the Greater Clearwater Area and Environmental Project Review Records are on file in the City of Clearwater’s Economic Development and Housing Department. It is available for public examination and copying, upon request during the weekday hours of 8:00 a.m. to 5:00 p.m.
All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments for consideration for the related activities and projects. Such written comments should be received at the main office of the Clearwater Economic Development and Housing Department located at 112 South Osceola Avenue, Clearwater, FL 33756 by September 10, 2010. All such comments so received will be considered and based upon their merit to determine the next course of action.

PROPOSED AMENDMENT TO INTERLOCAL AGREEMENT
The City of Clearwater proposes to amend an existing Interlocal Agreement with Pinellas County to extend the term of the agreement from October 1, 2010, to September 30, 2020, in accordance with Chapter 163.3171(3), Florida Statutes. The purpose of the Interlocal Agreement is to enable the City to advise both the County and the owners of unincorporated property within the Clearwater Planning Area of the long-range planning objectives of the City. The Interlocal Agreement satisfies the plan amendment requirements of Chapter 163.3187, Florida Statutes, for annexed property when the provisions of the agreement have been met.
The Clearwater Planning Area consists generally of certain unincorporated lands lying outside the corporate limits of the City. Legal descriptions identifying the boundaries of the Clearwater Planning Area and the proposed Interlocal Agreement may be inspected by the public at the City of Clearwater Planning & Development Department, 100 S. A public hearing will be held by the City of Clearwater, in City Council Chambers, in City Hall, 3rd floor, 112 South Osceola Avenue, Clearwater, Florida, regarding the Penny for Pinellas project list for fiscal years 2010/11 through 2019/20 totaling $107,232,000 to fund capital projects under the Penny for Pinellas Plan.
The project list has been increased by $4,126,820 from an initial total of $103,105,180 to a proposed total of $107,232,000 as outlined in the attached document.
Primary changes include:
- Main Fire Station
The project budget for the Main Fire Station has been increased by $4,057,520. In 2006, $3 million in Penny II funds were used to establish a project to renovate or replace the Main Fire Station 45 located downtown. The additional $4,057,520 will provide the necessary funding to construct a category five rated station with living space for a diverse work force, room for equipment and apparatus bay, and office space for Fire Administration and Prevention Services.
- Fire Engines
The project budget for Fire Engine replacements has been increased by $69,300 primarily to reflect expected inflationary cost increases in three engine replacements planned in future fiscal years of the plan.

Persons without party status speaking before the CDB shall be limited to three minutes unless an individual is representing a group in which case the Chairperson may authorize a reasonable amount of time up to 10 minutes. The Community Development Board will review the case and make a recommendation to the City Council for final disposition.
