Interested parties may appear and be heard at the hearing or file written notice of approval or objection with the Planning and Development Director or City Clerk prior to the hearing.  Any person who decides to appeal any decision made by the Board or Council, with respect to any matter considered at such hearings, will need to request a record of the proceedings and, for such purpose, may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based per Florida Statute 286.0105.  Community Development Code Sec 4-206 states that party status shall be granted by the Board in quasi-judicial cases if the person requesting such status demonstrates that s/he is substantially affected.  Party status entitles parties to personally testify, present evidence, argument and witnesses, cross-examine witnesses, appeal the decision and speak on reconsideration requests, and needs to be requested and obtained during the case discussion before the CDB.

An oath will be administered swearing in all persons giving testimony in quasi-judicial public hearing cases.  If you wish to speak at the meeting, please wait to be recognized, then state and spell your name and provide your address.  Persons without party status speaking before the CDB shall be limited to three minutes unless an individual is representing a group in which case the Chairperson may authorize a reasonable amount of time up to 10 minutes.  The Community Development Board will review the case and make a recommendation to the City Council for final disposition.

Five days prior to the CDB meeting, staff reports and recommendations on the above requests will be available for review by interested parties between the hours of 8:30 a.m. and 4:30 p.m., weekdays, at the City of Clearwater, Planning and Development Department, 100 S. NOTICE OF REQUEST FOR APPROVAL
OF A
PRETREATMENT PROGRAM MODIFICATION

In accordance with the provisions of Chapter 62-625, Florida Administrative Code (F.A.C.), Marshall Street Water Reclamation Facility (WRF) has developed and submitted for approval by the Florida Department of Environmental Protection (DEP), a pretreatment program modification for its wastewater facility (WWF), consisting of revisions to the City’s Local Limits. DEP has made a preliminary determination that this pretreatment program modification meets the requirements of Rule 62-625.540, F.A.C. The requirements found in those rules are designed to assure the pretreatment program will: (a) prevent the introduction of pollutants into WWFs which will interfere with their operation, including the use or disposal of residuals; (b) prevent the introduction of pollutant into WWFs which will pass through the treatment works or be otherwise incompatible; and (c) improve opportunities to recycle and reclaim municipal and industrial wastewaters and residuals.

The City of Clearwater is estimated to receive $913,337 in grant allocation funds under the Community Development Block Grant (CDBG) Program and $532,649 in grant allocation funds under the HOME Investment Partnerships (HOME) Program for Federal Fiscal Year (FY) 2024-2025 beginning October 1, 2024. Funds can only be used in the incorporated limits of the City of Clearwater. However, an agency that is located outside the City may receive funding if they provide documented services for city residents.

Federal funding authorization for the CDBG Program and the HOME Program is through the U.S. Department of Housing and Urban Development. In addition to the grant allocations, the City anticipates that it will receive program income from the federal CDBG and HOME Programs.

These funds will primarily be used for housing, community, and economic development activities. A portion of the funds listed above may be used for City conducted and/or sponsored projects and may not be available for allocation to applicants. Federal regulations applicable to these programs dictate funding availability for certain projects. Proposals for new projects will be accepted beginning on February 14, 2024.  Suggestions for new projects/activities for FY 2024-2025 may be presented and should address one or more of the following strategies:

  • Promote better livable opportunities in a designated Neighborhood Revitalization Strategy Area (NRSA); NRSA maps are located at www.myclearwater.com/NRSAmaps
  • Promote affordable housing for renters and/or homebuyers
  • Promote efforts/activities to end chronic homelessness
  • Provide outreach and housing opportunities for homeless individuals and families
  • Provide assistance to victims of domestic violence
  • Promote economic opportunities for very low- to moderate- income individuals
  • Provide assistance to the elderly, persons with disabilities, and persons with HIV/AIDS
  • Develop public facility projects in the NRSAs
  • Promote efforts to reduce lead poisoning in children
  • Promote opportunities to end poverty (job training, employability skills, educational attainment, and other related activities)
  • Promote opportunities to assist public housing residents to become self-sufficient
  • Promote opportunities for individuals to reduce their dependency on alcohol and drugs
  • Promote fair housing opportunities

Eligible activities may include, but are not limited to, rehabilitation and preservation of buildings and improvements; acquisition and disposition of real property; acquisition, construction, reconstruction, rehabilitation or installation of public facilities and improvements; economic development activities; and activities by subrecipients to carry out neighborhood revitalization, energy conservation projects, and related projects.

Applications for organizations desiring to participate in the City of Clearwater Housing Pool for activities involving down payment assistance/gap financing, land acquisition, new construction, and rehabilitation of single- and multi-family housing will be accepted from eligible participants on a year-round basis while funds remain available.

Public Notice - Bausch & Lomb, Inc. located at 21 Park Place Blvd. N. Clearwater, Florida 33759 was in Significant Non-Compliance (SNC) with the City of Clearwater’s Industrial Pretreatment of Wastewater Ordinance

NOTICE OF VIOLATION:

In accordance with the requirements of Rule 62-625.500 (2)(b)8, Florida Administrative Code, notice is hereby given that Bausch & Lomb, Inc. located at 21 Park Place Blvd. N. Clearwater, Florida 33759 was in Significant Non-Compliance (SNC) with the City of Clearwater’s Industrial Pretreatment of Wastewater Ordinance, Article V. Division 2. Sec. 32.219(a) and (b). TECHNICAL REVIEW CRITERIA (TRC): Copper concentrations exceeded 1.2 times the daily limit (1.2 X 0.020lbs/day= 0.024 lbs/day) in 4 out of 7 samples, or 57.14% of the measurements taken. Bausch and Lomb was also in chronic SNC for the rolling quarter. They exceeded the copper limit of 0.020 lbs/day in 5 out of the 7 copper samples, or 71.42% of the measurements. Both exceedances took place during the rolling quarter of 07/01/2023-12/31/2023.

Notice of Draft Permit for Master Reuse System

The Department of Environmental Protection gives notice of its preparation of a draft permit to the City of Clearwater Public Utilities Department, Mr. Richard Gardner, 1650 North Arcturas Avenue Building C, Clearwater, Florida 33765 for the City of Clearwater Master Reuse System. This permit renewal authorizes the permittee to operate a master reuse system which land applies up to a 12.0 million gallons per day (MGD) annual average daily flow (AADF) of reclaimed water to a Part III slow-rate public access system, serving the general service area of the City of Clearwater and the City of Safety Harbor. The permit also allows for the transfer of up to 3.0 MGD AADF Part III public access reclaimed water to the Pinellas County’s William E. Dunn WRF Master Urban Reuse System (FL0128775). In addition, golf course irrigation storage lakes are included with a stormwater discharge (D-001) at the Countryside Country Club Pond and (D002) at the Belleair Country Club Golf Course Pond in Pinellas County. The Department has assigned permit file number FL0186261-010-DW1R/NR to the proposed project.

The permit application file and supporting data are available for public inspection during normal business hours, 8:00 a.m. to 5:00 p.m., Monday through Friday, except legal holidays, at the Department's Southwest District Office, 13051 N Telecom Pkwy, Suite 101, Temple Terrace, Florida 33637-926, at phone number (813)470-5700.

The Department of Environmental Protection ("Department") gives notice of agency action of entering into a Consent Order with City of Clearwater pursuant to section 120.57(4), Florida Statutes. The Consent Order addresses the effluent quality exceedances, unauthorized discharges, and overflows at the facilities and its collection system. The Consent Order is available for public inspection during normal business hours, 8:00 a.m. to 5:00 p.m., Monday through Friday, except legal holidays, at the Department of Environmental Protection, Southwest District, 13051 N. Telecom Parkway, Suite 101, Temple Terrace, Florida 33637.

Persons who are not parties to this Consent Order, but whose substantial interests are affected by it, have a right to petition for an administrative hearing under sections 120.569 and 120.57, Florida Statutes. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition concerning this Consent Order means that the Department's final action may be different from the position it has taken in the Consent Order.

The petition for administrative hearing must contain all of the following information:

a) The OGC Number assigned to this Consent Order;

b) The name, address, and telephone number of each petitioner; the name, address, and telephone number of the petitioner's representative, if any, which shall be the address for service purposes during the course of the proceeding;

The facility is located at latitude 28 o 1' 41.09" N, longitude 82 o 42' 17.72" W. on 3290 S.R. 580, Clearwater, Florida 34695 in Pinellas County. The City of Clearwater is hereby publishing the proposed Annual Action Plan (AAP) for Federal Fiscal Year (FY) 2024 to allocate federal funding from the Community Development Block Grant Program (CDBG) and HOME Investment Partnerships Program (HOME) under the U.S. Department of Housing and Urban Development (HUD). The AAP identifies projects and activities to be implemented by the City during FY 2024, which begins on October 1, 2024, and ends on September 30, 2025. In addition to the entitlement grant, funding allocations also include anticipated program income generated by the City’s Revolving Loan Fund as well as prior-year (i.e., carryover) resources from projects that were either cancelled or completed under budget to be applied toward new projects. CDBG funds are used to provide decent housing, suitable living environments, and economic opportunities to principally benefit low- and moderate-income persons. HOME funds are used to foster private sector partnerships with for-profit and non-profit organizations to develop affordable housing.

The City of Clearwater anticipates an estimated $940,482 in new CDBG funds, $1,310,415 in CDBG program income, and $367,097 in prior-year CDBG resources. The City also anticipates an estimated $400,222 in new HOME funds, $1,706,038 in HOME program income, and $2,791,413 in prior-year HOME resources. These funds will be programmed to eligible activities under these grant programs.

The list below captures all proposed projects to be funded with CDBG and HOME resources in FY 2024. Funding for these and other projects are estimated resources only and funding amounts may increase or decrease based upon actual program income, prior-year adjustments, and/or final federal funding allocations. Due to these and other factors, the City of Clearwater reserves the right to add or delete projects and/or adjust funding allocations proportionally.
